Click each topic below to review the summary, example, and Indiana bill reference.

Owner Obligations Still Apply | HB 1210 View HB 1210

Owners must still pay assessments and follow governing documents even if the association cannot establish quorum.

Example: An owner cannot ignore parking rules simply because the HOA failed to reach quorum.
Budget Increases Without Quorum | HB 1152 View HB 1152

Newer associations may approve limited budget increases when quorum cannot be reached, if allowed by governing documents.

Example: A post-July 1, 2026 HOA may be limited to a 105% budget increase instead of a larger jump.
Payoff & Resale Letter Fee Cap | HB 1115 View HB 1115

Payoff or resale letter fees charged to owners are capped at $50. Simple balance statements must be provided at no charge.

Example: A seller requesting a payoff letter may only be charged up to $50.
Optional Service Fees | HB 1115 View HB 1115

Optional service fees must be listed, board-approved, and disclosed to owners.

Example: Key fob replacements, clubhouse rentals, and dock fees should appear on a published fee schedule.
Association Fine Authority | HB 1115 View HB 1115

Indiana associations may issue fines, but they must adopt a fine schedule and follow proper notice procedures.

Example: Before fining for trash cans left out, the HOA should identify the violation, fine amount, and whether it may recur.
Voting Threshold Lowered to 2/3 | HB 1115 View HB 1115

Certain owner approval requirements may not require more than a two-thirds vote.

Example: A document provision requiring 75% approval may no longer control for covered votes.
Rental Restriction Voting | HB 1210 View HB 1210

For rental restriction votes, only homestead owners may vote beginning July 1, 2026.

Example: Investor-owned rental homes may be excluded from voting on rental caps or rental bans.
Records Production Fees Removed | HB 1115 View HB 1115

Associations may no longer charge homeowners for producing records requested under inspection rights.

Example: An owner requesting board-approved records cannot be charged a copying or compiling fee.
Board & Annual Meeting Notices | HB 1115 View HB 1115

Boards must provide at least four days’ written notice before board meetings, including the agenda.

Example: A board meeting notice emailed Monday for a Friday meeting should include the agenda.
In-Home Childcare | HB 1152 View HB 1152

Associations may not prohibit certain licensed in-home childcare operations.

Example: A resident operating a permitted Class I childcare home may not be automatically banned by HOA rules.
Amateur Radio Antennas | HB 1152 View HB 1152

HOAs may not prohibit residents from maintaining amateur radio antennas.

Example: A blanket ban on ham radio antennas would not be enforceable.
Flags, Fuel Source & License Plate Readers | HB 1150 View HB 1150

Associations must allow American and Indiana flags, cannot discriminate based on fuel source, and cannot operate license plate reader systems unless law enforcement controls the data.

Example: An HOA may regulate flag placement reasonably, but cannot completely ban display of the American flag.
