The Central Indiana Chapter of CAI is pleased to announce the chapter’s first ever HOA Law Symposium for Board members and community managers. The half-day seminar is designed to provide timely education on some of the most important legal and practical issues facing Indiana homeowner associations and condominium associations. Seminar sessions will be presented by community association attorneys who devote their law practices to representing associations. Topics will include the following:
- Collecting Delinquent Assessments
Assessments are the lifeblood of a community association, and boards do a disservice to their communities if they fail to routinely pursue delinquent accounts. Presenters at this seminar will discuss the importance of establishing and adhering to clear collection policies, effective communication with the homeowners, budgeting, understanding the legal rights and requirements imposed by the association’s documents, and tackling delinquency problems before they start. The seminar also will offer an overview of the various legal remedies available for collecting unpaid assessments.
- Running Membership Meetings and Dealing with Difficult Owners
Membership meetings can be one of the most challenging and stressful parts of HOA governance. Our presenters are here to help. This seminar will cover a host of essential topics, including proper meeting administration, elections and voting, proxy usage, quorum issues, virtual meetings, electronic voting, dealing with disruption, and navigating requirements under Indiana law. In addition, the presenters will discuss strategies for maintaining order in contentious meetings and dealing with disruptive and abusive homeowners.
- Architectural Control Issues and Enforcement
Architectural control is pivotal in maintaining the aesthetics and uniformity of a community. It is also one of the most contentious, emotional, and litigated issues in HOA law. It is imperative for an HOA to uniformly implement clear standards and procedures. This seminar will cover an array of topics, including the authority of an association to regulate exterior changes, establishing effective procedures, drafting and implementing architectural guidelines, compliance and enforcement issues, and dealing with common practical and legal problems.
